You can't change the law if you can't get through the door.  But recent decisions have made it harder and harder for progressive lawyers to undertake impact litigation.  What new procedural barriers do progressive lawyers face?  What is the effect of the heightened pleading standards ?  What is the state of the war on mandatory arbitration and class action bans?  What is lost for employees, consumers, prisoners, and discrimination victims when litigation opportunities narrow?
